Kerry Care Company (“Kerry,” “we,” “our”) values your privacy. This Privacy Policy explains how we collect, use, disclose, and safeguard personal information when you use our Service.

- Information You Provide: Name, contact details, demographic information, care recipient data, health‑related notes, payment details.
- Automatically Collected: Device information, log files, IP address, usage analytics, cookies and similar technologies.
- From Third Parties: Information from care providers, family members, or integration partners to facilitate your use of the Service.
3. Sensitive Personal Information
To the extent you choose to provide health or other sensitive information, you consent to our processing of that information to deliver the Service. Kerry is not a HIPAA‑covered entity, but when acting as a Business Associate we will comply with applicable HIPAA obligations.
4. How We Use Information
- To provide, maintain, and improve the Service and AI models.
- To communicate with you, including transactional and promotional messages.
- To personalize the Service.
- For analytics, research, and security.
- To comply with legal obligations.
AI-Model Improvement Safeguards: Before using personal data for model training or tuning we de-identify or aggregate it. We do not share your identifiable data with third-party model providers for their own purposes without separate consent.

We rely on: performance of a contract, legitimate interests, consent, and compliance with legal obligations.

We may share information:
- With service providers (cloud hosting, telephony, AI model vendors) bound by confidentiality.
- Within a Care Circle as directed by you.
- With third parties in connection with a business transfer.
- When required by law or to protect rights, safety, or property.
We do not sell personal information. We also do not share mobile information (including phone numbers or SMS/WhatsApp consent data) with third parties or affiliates for their marketing or promotional purposes.
7. Cookies & Tracking Technologies
We use cookies and similar technologies for authentication, preferences, and analytics. You can control cookies through browser settings.
8. Data Retention
We retain personal information as long as necessary to fulfill the purposes outlined in this Policy, comply with legal obligations, or resolve disputes. SMS consent records are retained for at least four years as required by applicable telecommunications regulations.

We implement administrative, technical, and physical safeguards designed to protect information. No system is perfectly secure; we cannot guarantee absolute security.
10. Your Rights & Choices

11. Marketing Communications
You may opt out of marketing emails at any time by following unsubscribe instructions or contacting us. Opt‑out does not apply to transactional communications.
12. SMS Communications
By providing your mobile phone number and opting in to receive SMS messages from Kerry, you expressly consent to receive text messages from us using automated technology. This consent is not required to purchase any goods or services.
Message Frequency & Charges:
- Message frequency varies based on your Service usage, care needs, and notification preferences. You may receive anywhere from a few messages per month to several messages per day during periods of active care coordination.
- Message and data rates may apply. Check with your mobile carrier for details about your messaging plan.
- Kerry does not charge for SMS messages, but carrier charges may apply.
SMS Data Collection: When you send or receive SMS messages, we may collect and process mobile phone numbers, message content, delivery receipts, timestamps, opt-in records, and device information to provide the Service and ensure compliance with applicable laws.
Opt-Out Instructions:
- Reply STOP to any text message to opt out immediately.
- You can also contact us at privacy@kerry.care to opt out.
- After opting out, you will receive one final confirmation message.
- Opting out of promotional SMS does not affect transactional or service-related messages necessary for the Service.
**TCPA Compliance:**We comply with the Telephone Consumer Protection Act (TCPA) and industry guidelines. We maintain records of your SMS consent for at least four years as required by law. We will not send you autodialed or prerecorded marketing messages without your prior express written consent.
SMS Data Sharing: We do not sell, rent, or share your mobile phone number or SMS consent data with third parties for their marketing purposes. We may share this information with our service providers (such as SMS platform providers) who are bound by confidentiality agreements and use the information solely to provide services to us.
13. WhatsApp Communications
If you opt in to receive WhatsApp messages, Kerry may send you transactional or support messages via WhatsApp Business API. Message frequency mirrors your Service activity; data charges may apply.
Data Collected: Data Collected: phone number, WhatsApp message IDs, delivery receipts, timestamps, and (where applicable) message content. End-to-end encryption limits Kerry’s access to message content; we store only necessary metadata.
Opt-Out: Send STOP in WhatsApp or adjust your WhatsApp settings at any time. We respect WhatsApp Business Policy and will not use WhatsApp for unsolicited marketing without your opt-in.
14. Telephone & Voice Communications
Kerry may place live or automated voice calls for care coordination or urgent alerts. We obtain prior express written consent for any autodialed or prerecorded marketing calls as required by the Telephone Consumer Protection Act (TCPA).
Data Collected: dialed numbers, call timestamps/duration, and—if you consent—call recordings. Recordings are retained for 180 days unless longer retention is required for dispute resolution.
Opt-Out: You can request to be placed on our do-not-call list during any call or by emailing privacy@kerry.care.
15. International Transfers
We may transfer personal information to countries outside your jurisdiction. When we do, we use appropriate safeguards such as Standard Contractual Clauses.
16. Children’s Privacy
The Service is not directed to children under 13. We do not knowingly collect personal information from children. If we learn that we have, we will delete it immediately.
17. Changes to This Privacy Policy
We may update this Policy periodically. We will notify you of material changes by email or through the Service. Continued use after changes means acceptance.
